EU AI Act: first regulation on artificial intelligence

In a historic move, the European Union (EU) is set to unveil the world's first comprehensive AI law, the AI Act, a groundbreaking piece of legislation that will reshape the regulation of artificial intelligence (AI) across diverse sectors. Formulated as part of the EU's ambitious digital strategy, this pioneering legislation, proposed by the European Commission in April 2021, aims to establish a secure and transparent framework for the development and deployment of AI technology within the EU.

The key priorities outlined by the EU Parliament highlight the imperative of ensuring safety, transparency, traceability, non-discrimination, and environmental sustainability in AI systems. With a strong emphasis on human oversight to avert adverse outcomes, the legislation endeavors to create a technology-neutral, uniform definition of AI that will be applicable to future systems, fostering ethical and responsible AI practices.

The AI Act introduces a nuanced categorization of AI systems into different risk levels, each subject to specific regulatory measures:

  1. Unacceptable Risk: This category encompasses AI systems deemed a threat to individuals, such as those engaged in cognitive behavioral manipulation, social scoring, and real-time biometric identification. The legislation proposes a categorical ban on such systems, with limited exceptions like post-identification for serious crimes, subject to court approval.

  2. High Risk: AI systems that significantly impact safety or fundamental rights fall into this category and are further divided into two subcategories. The first involves systems used in products governed by EU product safety legislation (e.g., aviation, medical devices), while the second covers specific areas like law enforcement, migration control, and critical infrastructure. All high-risk AI systems are mandated to undergo rigorous assessment before market entry and throughout their lifecycle, ensuring continuous scrutiny.

  3. Limited Risk: Systems with minimal risk, including generative AI models like ChatGPT, must comply with transparency requirements. This involves disclosing that content was generated by AI, preventing illegal content generation, and publishing summaries of copyrighted training data.

The EU Parliament, demonstrating its commitment to responsible AI governance, adopted its negotiating position on the AI Act on June 14, 2023. Subsequent negotiations with EU member countries in the Council are poised to commence, with the overarching goal of finalizing the law by year-end. This significant stride toward responsible AI deployment underscores the EU's commitment to setting a global standard for ethical and accountable AI practices, ensuring the protection of users in the rapidly evolving digital landscape. The AI Act is poised to be a landmark piece of legislation, heralding a new era of responsible and human-centric AI development.
